A Streetsboro man is facing felony charges stemming from an allegation that he assaulted a 69-year-old neighbor with a metal pipe and his fists.

James Zackary, 39, of Wellman Road, was arraigned in Portage County Municipal Court on Monday on two counts of second-degree felony assault in a grand jury indictment.

According to a complaint Streetsboro police filed in Portage County Municipal Court in Kent, Zackary punched his neighbor "multiple times and assaulted him with a metal pipe, causing injuries to his head, eye, elbow, and arm" at a Wellman Road address near Zackary's home on July 27.

Zackary's attorney, Danny Weisenburger, said he was still gathering information about the case and he declined to comment.

Streetsboro Police Lt. Rich Polivka said that when officers arrived at the scene, they found the 69-year-old standing in the road bleeding from cuts to his head, arms and elbow. One of the man's eyes was black and blue and partially swollen shut, said Polivka, and there was blood splattered on a nearby driveway. Polivka said there was apparently an issue between the two men that led to the alleged assault.

EMS took the neighbor to UH Portage Medical Center. Polivka said he did not know how long the man was in the hospital, but he may have been released by Aug. 1 when a police officer was able to get a written statement from him.

Polivka said officers went to Zackary's home shortly after the alleged assault but were unable to contact him, and a warrant was issued for his arrest. Twinsburg police arrested Zackary on July 30 and turned him over to Streetsboro police, who took him to Portage County Jail.

Zackary is free on a $50,000 bond, posted by a bail bonding firm. Conditions of the bond include that he have no contact with the neighbor and that he be placed on electronically monitored house arrest, with work privileges.

Zackary is scheduled for an Oct. 25 jury trial. Also scheduled are a Sept. 21 status conference and pretrial hearing and an Oct. 19 pretrial hearing.
